Legal protection of rights
① Protection under the Labor Standards Act
The standard working hours are 40 (44) hours a week (eight hours a day). The hours are extendable upon agreement between parties.
※ [Supplementary Rule] New standard working hours (40) are applicable according to the following schedules.
- Organizations with: between 50 and 100 employees (Applicable from July 1, 2007)
between 20 and 50 (from Aug 1, 2008)
less than 20 (by 2011)
Workers’ wages will be paid in cash or to their bank accounts on the date specified in the employment contract
※ Employers are not allowed to deduct or save any or all of the workers' wages without their consent.
Workers are entitled to receive overtime pay for extended working hours, working at nights (22:00-06:00) or on holidays. (Not applicable to organizations with less than 4 employees)
※ For those organizations covered by the Departure Guarantee Insurance, workers’ severance pay can be paid by the insurance benefits.
- However, if the insurance benefit amount is less than the severance pay, the difference must be paid to workers separately.
